The Problems Presented By a Relocation or Move-Away

When a custodial parent seeks to relocate with a child it jeopardizes the child's relationship with the other parent. In some cases, a reasonable solution can be achieved through negotiation between the parties, which enables the other parent to maintain that relationship. A good example of a negotiated relocation solution would be where the child spends summers with the non-custodial parent.

If one parent challenges the move, and a solution cannot be worked out in mediation or negotiation, then litigation is almost certain to result. In such cases, the Court must consider the best interests of the child in determining whether or not to grant permission for the relocation.
