Working to Ensure Fairness and Justice Through Set Aside Judgments

Under California divorce law, each spouse is entitled to one half of the assets accumulated during a marriage. Grossly unequal division of assets is one possible grounds to set aside a judgment. We routinely represent clients seeking to set aside judgments as a result of fraud, duress, coercion, judicial error, or failure to disclose an asset. You only have one to two years (depending on the circumstances) from the date of discovery of fraud or non-disclosure, to move for the set aside.

To determine a fair arrangement — each spouse is required to fully disclose their finances, including both assets and liabilities. In the event that this disclosure is incomplete, the judgment may be set aside after the divorce is finalized so that a truly fair arrangement can be established.

Effectively Handling Complex Financial Matters

In complex divorce cases involving the division of community property, child support, or spousal support, large sums of money are often at stake. These are the cases that are most likely to involve hidden assets, and the potential to have a judgment set aside.

Determining that one person has hidden assets requires the ability to handle complicated financial matters. To effectively resolve these cases, a lawyer must be able to skillfully read financial statements, locate hidden assets, and properly seek relevant information from banks and companies.

We have the skill, experience and resources to effectively address even the most complicated family law matters. Most of our investigative work is done in-house. We routinely work with experience investigators to locate hidden assets and protect our clients' interests.
